In response to a request from the Bulgarian Industrial Capital Association, the Ministry of e-Government confirmed that when signing documents with a qualified electronic signature (QES) by individuals representing legal entities, the QES certificate does not need to contain information about the person's position or a unique identification code (UIC/Bulstat).
According to the European and national legal framework, the holder of the electronic signature can only be an individual, and the legal force of the QES is equated to that of a handwritten signature. The legislation does not provide for an obligation to include attributes such as position or representative function in the certificate. The representative authority is verified through the registers of the relevant primary data administrators, which guarantees legal certainty and clarity when electronically signing documents on behalf of companies.
